Tax Residency

If you’re someone who travels internationally and spends significant periods outside the UK, it’s important to explore your residency status for tax purposes. We can help you navigate a set of potentially complex set of rules.


Your UK residence status will determine whether you have tax to pay in the UK. If you are physically present in the country for 183 days or more during a tax year, you will be classed as a resident in the UK for that tax year. If you are in the UK for fewer than 183 days in a tax year, you could still be deemed to be a resident in the UK, depending on a number of factors. HMRC introduced a Statutory Residence Test in 2013 to help determine residency status.

How do the residence tests work?

There are two tests, called the ‘automatic overseas’ or ‘automatic UK’ tests, which determine whether you are automatically deemed UK or non-UK resident. If you do not meet either of the automatic tests, you would need to use the ‘sufficient ties’ test to determine your tax residence status.

We can complete all of this work on your behalf, saving you the time and hassle of the process of determining whether you must pay UK tax, understanding the complex rules and completing the paperwork.

The automatic UK tests are quite detailed, however. In summary, they include:

  • Spending 183 days or more in the UK
  • Having a home in the UK for longer than 90 days (and being in the home for at least 30 separate days)
  • Working full-time in the UK for 365 days or more over two tax years
